The Seller Guarantee to the Buyer:

1. The puppy will have had its first vacination and will be wormed twice and have a health check-up by a licensed veterinarian prior to giving ownership to buyer.  As of the date that puppy is transfered to buyer the puppy is guaranteed to be in good health and free of Communicable Disease. The buyer has 48 hours within delivery/acceptance of said puppy to have puppy examined by a licensed veterinarian at their expense. Any claims for return of puppy due to any of the above mentioned must be within that 48 hour time-frame.  No replacement will be offered in case of Parvo, Corona, Distemper, or Kennel Cough.  The pup has received proper vaccinations against these illnesses and none of these illnesses have been present at our kennel.  Due to the highly contagious nature and rapid progression we cannot be held liable as the puppy may have been exposed after it left our care. 

2. We guarantee the puppy to be free of any inheritable disease that causes death or serious impairment of vital functions in the puppy until it is one (1) year of age.  If such an inheritable disease is documented by a veterinarian and presented to the seller with sufficient supporting evidence, the buyer will be entitled to a replacement puppy of comparable quality from that litter or the next available litter.  The seller reserves the right to a second veterinarian opinion at the expense of the seller.  This guarantee does not cover what we consider normal problems in the Bulldog breed or problems beyond our control:  Cherry Eye, Entropian (eye lids that turn in and irritate the eye), "Loose Hips", or skin allergies such as Localized Demodectic Mange.  Majestic Oldes does not breed dogs with such undesirable conditions.  All of our dogs go through a total health physical performed by our veterinarian just before each breeding takes place and the dogs are only bred if both are found to be 100% healthy, but we cannot guarantee that previous generations did not have these conditions in their lines.  [ At no  time is the seller responsible for  any vet expenses or  illness, defects/conditions caused by buyers neglect,  abuse, improper nutrition,  mishandling  or any injuries to puppy caused by said conditions.].

3. ________________________ Understands that this puppy is being sold as a pet and not for breeding.  He/she also understands and agrees that the puppy shall be spayed/neutered by six months of age.  A copy of the veterinarian's certificate of spay/neuter must be received by the seller no later than 9 months of age.  Should the purchaser fail to comply with these conditions, the seller has the right to reclaim the dog immediatley.  No refunds will be made at any time.  Any expenses incurred by the seller to collect the puppy will be the sole responsibility of the buyer.

4.This contract only applies to the Original Purchaser and IS NOT Transferable if the pup/dog is resold or given to someone else.

5.Majestic Oldes has first buy back rights on said puppy/dog if owner decides to sell or give away. We will also offer to help you in finding a good replacement home.

6. No Guarantees are given for the temperment or the fitness of the animal for Specific Intended Purposes. If the puppy develops an illness before the new owner picks up, the breeder has the right to hold onto sick pup and not sell, and offer buyer another puppy of equal or greater value from another litter.  See #10 of agreement. If the puppy becomes ill from a genetic problem Majestic Oldes will replace the puppy with another of equal value when one is available. For any major illness Majestic Oldes has the right to request the dog/pup be sent to the vet of their choice for a second opinion or treatment.

7. The Buyer is respondsible for all shipping charges, crate charges, and any other charges the shipping airlines may charge. This applies to the original purchase puppy and/or replacement puppy if needed.

8. The Buyer agrees that any puppy or dog purchased from Majestic Oldes will never be tied outside for prolonged periods of time.  The Buyer further agrees the puppy will always be provided with adequate food, water, and shelter.

9. If the puppy or Dog that is subject to this contract ever shows signs and evidence of neglect or abuse, at anytime in its life, ownership and title to said puppy or dog will revert immediately back to the seller.

10.This Contract is agreed upon by both buyer and seller. Deposits are NON-Refundable and any amounts paid for puppy will be transfered to another puppy of equal or greater value if buyer changes their mind about chosen puppy / or the puppy due to health issues can not be sold to buyer or returned from buyer for health reasons.

11. The Purchaser hereby releases the Seller from any and all liability coming out of the sale, raising or training of the above mentioned puppy or dog. The Purchaser further expressly agrees to indenmnity and hold harmless the Seller with respect to any alleged liability or liabilities that the Seller may be charged with including the tendering of defense to the seller, by the purchaser in the event litigation occurs by reason of the activities raising or training of the puppy or dog.

12. The Buyer agrees the above mentioned puppies name shall be included on any and all registration submitted to CKC or IOEBA the name of 'Majestic Oldes" which will be written on the initial application form for submission to CKC and IOEBA.

13.  Puppy must be paid for in full by 6 weeks of age.  Puppy will be picked up or shipped by 9 weeks of age.  If the puppy is not picked up or shipped by 9 weeks a $50 per week boarding fee will be charged.  Puppy must be paid in full before it is shipped.

14. ANY AND/OR ALL CONTROVERSIES AND/OR DISPUTES ARISING UNDER THIS CONTRACT ARE SUBJECT SOLELY AND EXCLUSIVELY TO THE LAWS OF THE STATE OF ILLINOIS.

15.THIS CONTRACT IS THE BUYERS RESPONDSIBILITY TO SIGN AND GIVE TO MAJESTIC OLDES. IF A SIGNED COPY IS NOT SENT TO MAJESTIC OLDES WITHIN 60 DAYS OF DOG/PUPPY PURCHASE, THE BUYER WILL FORFIET ALL GUARANTEES THE SELLER IS OFFERING, AND NO FURTHER CLAIMS CAN BE MADE. THE PURCHASER HAS READ ALL OF THE FOREMENTIONED AND UNDERSTANDS AND AGREES WITH THE ABOVE PROVISIONS, AND ACKNOWLEDGES A RECIEPT OF A COPY OF THIS AGREEMENT.
